The world of special education can be complex and overwhelming. You arrive at the IEP meeting and are greeted with a 20+ page document explaining your rights and another 20+ page document with the individual plan for your child. It’s a lot to take in.

Understanding your rights allows you to walk into that room feeling confident, ready to advocate for the supports, goals, and services your child need. You’re able to collaborate with the school and feel like the true team member that you are.

Here are the top 5 rights I want every parent to understand.

Meeting Attendance and Notification

You have the right to:

Be notified of every IEP meeting and attend every IEP meeting.
Bring a support person, advocate or attorney with you to the meeting.
- Always let the school know who you plan to bring in advance.
Request the meeting to be held at a time that is convenient for you.

2. Confidentiality

You have the right to:

Provide authorization for the school to release your child’s records to an outside service provider.
Expect a high level of confidentiality and professionalism from the teachers working with your child.

Your child’s disability and services are not public knowledge. Only the staff that are working directly with your child should know about the details of the IEP.

3. Records

You have right to:

Review your child’s records (and ask your attorney or advocate to review them too).
Ask for an amendment to the records if you disagree with something stated in the records.

4. Consent for Evaluation and Placement

You have the right to:

Give consent for evaluations and special education services (or not give consent). The school cannot evaluate your child without your consent.

5. You have a voice in decisions.

You have a right to:

Be an equal, participating member of the IEP team.
Voice your concerns, questions and aspirations for your child.
